General terms and condition of Dr. Sommer Werkstofftechnik (SWT) GmbH – seminars

This is a translation just for your convenience. Only the general terms of conditions in German language apply to the legal validity.

1. General Information
All services within the scope of our seminar events are based on these “General Terms and Conditions” of Dr. Sommer Werkstofftechnik GmbH.

2. Registrations and Conclusion of Contract
You can register with us by telephone, in writing, by fax or by e-mail. You will then receive the confirmation of registration (date of contract conclusion). Since the number of participants for our seminars is limited, we will consider registrations in the order of receipt. Company-specific seminars are excluded from such an order. The number of participants is determined with the customer. Your data will be stored electronically for internal purposes.

3. Cancellations and Right of Withdrawal
For cancellations up to 14 days before the start of the event, we charge a processing fee of 20% of the seminar fees plus VAT. After this deadline, the full participation fee is to be paid according to the invoice. It is possible to name a substitute person. Should cancellation fees be incurred for reservations made on behalf of the customer (e.g. hotel reservations), these will be invoiced in full to the customer regardless of the date of cancellation. In principle, the cancellation must be made in writing. If an event must be cancelled for unforeseeable reasons, a notification will be sent. In this case there is only the obligation to refund the participation fee already paid; there are no further claims.

4. Fees
The fees for attending our seminars are payable immediately upon receipt of the invoice.
Participation in our seminars only temporarily does not entitle you to a reduction of the seminar fee.

5. Performance Deviation
We reserve the right to change the dates of execution.

6. Copyright
The seminar documents provided by Dr. Sommer Werkstofftechnik GmbH are included in the agreed remuneration unless otherwise agreed. We reserve all rights, including those of translation, reprinting and reproduction of the seminar documents or parts thereof. No part may be reproduced in any form – even in part – without the written consent of Dr. Sommer Werkstofftechnik GmbH, including for the purposes of seminar design. In particular, no part may be processed, copied or used for public reproduction using electronic systems.

7. Subject to Alterations
Our range of seminars is constantly updated. In our online seminar planner, you will find all information always up-to-date. We reserve the right to make necessary adjustments or deviations in the content and methodology of our seminars, provided that these do not significantly change the overall character of the seminar in question.

8. Liability
In our seminars, lessons and exercises are designed so that an attentive participant can achieve the seminar goals. However, we are not liable for the success of the training.

9. Applicable Law
The contractual relationship and its execution shall be governed exclusively by the laws of the Federal Republic of Germany.

10. Final Provisions
Changes and additions to the agreements must be made in writing. Should a provision in these terms and conditions or in the contract be or become invalid, the validity of all other provisions or agreements shall not be affected. Place of jurisdiction for all disputes arising from the contractual relationship is Geldern
